Penalties

Violations of this Chapter, if charged pursuant to Chapter 1.20, shall be charged as infractions. Violations of this Chapter are also punishable pursuant to Chapter 1.28. (Ord. 7397-NS ยง 5 (part), 2015)

Exemptions

Data Disclosure:

An exemption from ENERGY STAR Performance Report requirement for any current reporting period may be granted if:

1. The building owner is unable to obtain tenant authorization of tenant utility data.
2. The building occupant demonstrates that disclosure may result in the release of proprietary information.
